Summary:

HWA proposes to amend its regulations governing the accommodation of utilities on the right-of-way (ROW) of Federal-aid or direct Federal highway projects to implement requirements of the Consolidated Appropriations Act, 2018, for broadband infrastructure deployment.

This proposed Federal Highway Administration (FHWA) regulation amends existing regulations governing the accommodation of utilities on the right-of-way of Federal-aid or direct Federal highway projects to implement requirements of the Consolidated Appropriations Act, 2018 that facilitate broadband deployment.

Internet Service Provider

Eligible Recipients Detail:

Internet Service Providers and contracted firms renovating or building broadband.

Eligible Purpose:

Last Mile Infrastructure; Middle Mile Infrastructure; Backbone Infrastructure; Broadband Development Planning

Eligible Purpose Detail:

Right-of-way access for utility renovation or construction at Federal-aid or direct Federal highway projects.

Other Eligibility Criteria:

The requirements, which will apply to each State that receives Federal funds under Chapter 1 of Title 23, United States Code (U.S.C.), aim to facilitate the installation of broadband infrastructure.

The proposed rule will implement provisions of the MOBILE NOW Act (codified at 47 U.S.C. ยง1504) to ensure that States meet specific registration, notification, and coordination requirements for such broadband infrastructure ROW efforts.
